1. Who these terms are between
These terms are between Falmoran (“we”) and the company or person using Falmoran (“you”). By creating an account or using the app you accept them. If you use Falmoran for a company, you confirm you may accept them for that company.
2. What Falmoran does
Falmoran classifies goods under the US Harmonized Tariff Schedule, reads the Chapter 99 measures that may apply (such as Section 232 and Section 301), screens for anti-dumping and countervailing duty cases, and keeps a record of the facts, who stated them, and the result. Where a fact is missing it asks; where it cannot decide it says so.
3. What Falmoran does not do
- It does not file entries with US Customs and Border Protection. A licensed customs broker, or you as importer of record, files the entry and is responsible for it.
- It does not give legal, customs, tax or financial advice. Results are information to support your decisions and your broker’s.
- It does not set anti-dumping or countervailing duty rates. Those are set per producer and exporter by the US Department of Commerce.
- It only covers what it says it covers. The limits are published.
4. Your responsibilities
Results depend on the facts given. You are responsible for the accuracy of the facts you, your team or your suppliers state, and for checking results before you rely on them. Keep your sign-in details private and tell us if you think your account has been misused. Do not use Falmoran to break the law, to probe or attack the service, or to access another company’s data.
5. Your data
Your products, shipments, documents and records belong to you. You give us permission to store and process them only to provide the service. You can export your data, and when you close your account we delete it as described in our privacy page. We may use counts and patterns with no customer identified (for example, which chapters are asked about most) to improve the engine.
6. Tariff data
The engine reads official US sources (the Harmonized Tariff Schedule and its Chapter 99 notes, Federal Register notices and Commerce case pages) as published on the date shown. Governments change these often and sometimes without notice. We update as soon as we reasonably can and show which edition each answer used.
7. Fees
Paid plans are billed as shown on the pricing page or in your order. Prices for an existing plan will not change without notice before your next billing period. The broker portal is free for licensed brokers, as described on the broker page.
8. Availability and changes
We work to keep Falmoran available but cannot promise it will never be interrupted. We may improve or change features; if a change removes something you rely on, we will tell you in advance where we can.
9. Responsibility for loss
Falmoran is provided to support, not replace, professional judgment. To the extent the law allows, we are not responsible for duties, penalties or losses that follow from facts that were wrong or incomplete, from decisions made without checking a result, or from changes in the law after a result was produced. To the extent the law allows, our total responsibility to you is limited to the fees you paid us in the twelve months before the claim.
10. Ending
You can stop using Falmoran and close your account at any time. We may suspend an account that breaks these terms. Either way, you can export your data first.
